Welcome to Shadowfern Editions! The terms “we”, “us” and “our” refer to Shadowfern Editions Pty Ltd. Shadowfern Editions operates this store and website, including all related information, content, features, tools, products and services (the “Services”). Shadowfern Editions is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”), together with our policies (including our Refund Policy and Shipping Policy), set out your rights and responsibilities when using the Services.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use or access our Services.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms, you confirm that you are at least the age of majority in your state or territory of residence, or that you have the consent of a parent or guardian to use the Services.

To use the Services, you may be asked to provide certain information (such as your email address, billing, payment, and shipping details). You agree that all information you provide is current, complete, and accurate.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

SECTION 2 - OUR PRODUCTS

All products offered by Shadowfern Editions are limited edition and produced on a pre order basis unless otherwise stated.

  • We aim to provide accurate descriptions and images, but product colours, finishes, or details may differ slightly depending on your device or printing variations.

  • All descriptions, prices, and availability of products are subject to change at any time without notice.

  • We reserve the right to discontinue or limit quantities of any product at our sole discretion.

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order at our discretion. An order is only accepted once payment has been processed and we provide confirmation.

  • Pre orders are final. Orders cannot be cancelled, changed, or refunded once placed (see our Refund Policy).

  • Pre order timelines are estimates only and may vary based on production, freight, customs, or supplier delays.

  • You represent and warrant that your purchases are for personal use only and not for resale or export.

SECTION 4 - PRICES AND BILLING

  • All prices are listed in Australian Dollars (AUD) unless otherwise noted.

  • Prices are subject to change without notice but will not affect orders already accepted.

  • Prices do not include shipping, handling, taxes, customs duties, or import charges, which are your responsibility.

  • You agree to provide complete and accurate billing information. By placing an order, you represent that you are authorised to use the payment method provided.

SECTION 5 - SHIPPING AND DELIVERY

  • All orders are fulfilled on a pre order basis. Production and estimated shipping timelines will be communicated, but dates are estimates only and may change.

  • Title and risk of loss pass to you once your order is handed to the shipping carrier.

  • We are not liable for delays caused by postal or courier services, customs, or events outside our control.

SECTION 6 - REFUNDS AND RETURNS

All sales are final. Shadowfern Editions does not accept returns, exchanges, or cancellations for change of mind or pre order products.
Exceptions apply only where required under Australian Consumer Law 

SECTION 7 - INTELLECTUAL PROPERTY

All content on the Services, including but not limited to text, logos, images, designs, and graphics, are the property of Shadowfern Editions or its licensors. You may not reproduce, distribute, or use our intellectual property without prior written consent.

SECTION 8 - THIRD-PARTY SERVICES

Our Services may include links to, or features provided by, third parties. We are not responsible for the content, accuracy, or practices of third-party websites or tools. Use of third-party services is at your own risk.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Shadowfern Editions is powered by Shopify, which provides the e-commerce platform. All sales are made directly with Shadowfern Editions. Shopify is not a party to any transaction between you and us.

SECTION 10 - DISCLAIMER OF WARRANTIES

Except as expressly required under Australian law, the Services and all products are provided “as is” and “as available,” without warranties of any kind, either express or implied.

SECTION 11 - LIMITATION OF LIABILITY

To the fullest extent permitted by law, Shadowfern Editions is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Services or any products purchased, except where such liability cannot be excluded under Australian Consumer Law.

SECTION 12 - INDEMNIFICATION

You agree to indemnify and hold harmless Shadowfern Editions, its officers, employees, and contractors from any claim, demand, or damage arising from your breach of these Terms or misuse of the Services.

SECTION 13 - GOVERNING LAW

These Terms are governed by the laws of Queensland, Australia. You agree to submit to the exclusive jurisdiction of the courts of Queensland in the event of a dispute.

We may update or revise these Terms at any time by posting changes on our website. Continued use of the Services following such changes constitutes acceptance of the revised Terms.
